We know, we know, legal stuff can be a snooze fest, but hey, even in the world of creativity, we gotta dot our i’s and cross our t’s. So buckle up and prepare for some necessary but slightly less exciting paperwork and security agreements. We’re all about making sure this creative journey is as smooth and protected as possible, so let’s get those legal ducks in a row and make everyone happy campers!
1. THE CREATIVE QUEST:
We, the Agency, shall wield our digital artistry skills to craft mind-blowing artwork for the Client.
Think graphic design, illustrations, and other rad creative content that will make your audience go, “Wowza!”
2. TIMELINES OF AWESOMENESS:
We promise to deliver the initial design concepts within [as stipulated in your proposal & quote] business days from today, because patience is overrated! And in return, we kindly ask the Client to provide feedback and sign off on each concept within [as stipulated in your proposal & quote] business days from receiving them. You’re the gatekeeper of coolness!
3. THE SIGN OFF RITUAL:
It’s time for the Client to unleash their thoughts! Once we present the design concepts, you’ll have the power to give us feedback and guide the creative process. Let the mystical “Sign Off” commence!
4. ROCKIN’ REVISIONS:
We’ve got your back, Client! You’re entitled to 3 rounds of revisions for each design concept we present. Just keep in mind that beyond that, we might have to call for an encore and charge some additional fees. But we’ll make sure to give you the heads up!
5. ARTWORK OWNERSHIP:
Drumroll, please! Once the Client has paid us in full for our incredible work, you’ll become the proud owner of the final approved artwork. It’s all yours to use and show off to the world! And don’t worry, we’d love to include it in our portfolio, with your permission, of course. We’re proud of our collaborations!
6. SECRET KEEPERS:
Let’s keep things hush-hush, shall we? Any top-secret or confidential information shared between us will remain classified. Your creative concepts and marketing strategies are safe with us, locked away in a vault guarded by ninjas.
7. PAYMENT DANCE:
Money talk time! The Client agrees to bust a move and pay the agreed-upon fees within 3 days of receiving our invoice (for all agreed upon payment terms – whether deposits, monthly payments, final settlements or other). Late payments might cause a temporary disconnection in our dance rhythm, so let’s stay on the beat! 28th is Great: New Payment Terms for a Happier Freelance Community Please note that we are now requesting that monthly payments be made by the 28th of the month of service – At Cloudscape, we pride ourselves on working with a talented and diverse group of creatives, many of whom are freelancers.
To ensure that we can continue to provide high-quality services and support our freelance artists, we kindly ask that all monthly payments be made by this date. By doing so, you’ll be helping us maintain a positive working relationship with our talented team and ensuring that we can continue to bring your creative projects to life. In accordance with the above 3 day notice period for payments, we will ensure that the invoices are sent out by the 25th COB each month.
8. TERMINATION CLAUSE WITH A TWIST:
Alrighty then, let’s talk about breakups! We get it, sometimes relationships need to end, but let’s do it with style. To keep our digital marketing breakup drama-free, we ask for a full calendar month’s notice for termination of our services. Think of it as giving us time to prepare for the equivalent of a farewell party – scheduling those last posts, unsubscribing from software subscriptions, and shedding a single tear for the good times we’ve had. So, let’s part ways amicably and with a little grace. After all, we’ll always have those likes, shares, and hashtags to remember each other by. Cheers to new beginnings!
9. BFF STATUS AND PARTING WAYS:
This Agreement marks the beginning of a beautiful friendship. However, if for any reason we need to take different paths, let’s give each other a heads up in writing. Communication is key, even when it’s time to part ways amicably.
10. THE RULES OF THE LAND:
This Agreement shall be governed by the laws of South Africa and the European Union, respectively. Any disputes that arise shall be resolved through friendly negotiations. No need for swords and shields—let’s keep it peaceful!

Please bear in mind that we, the Agency, are here to offer you an exceptional creative experience. Our team of talented artists and experts will provide you with awesome insight and experience.
● CLIENTS VISION TAKES THE STAGE:
However, we understand that as the Client, you may have a specific aesthetic and direction in mind, based on your own insight and experience in your niche. Even if it goes against our direction, we’ll respect your preference and bring it to life (within reason, of course!). We won’t compromise our values and beliefs, so we won’t put our stamp of approval on work that we don’t believe in.
● THE FINAL STAMP:
Embracing Subjectivity and Celebrating Artistic Payday! Speaking of aesthetics and tastes, artwork is a highly subjective process, and we respect that everyone has their own style and preferences. Once you, as the Client, have given the final sign off on the artwork, it indicates the end of the creative process. At this point, both our in-house teams and hardworking freelancers need to be paid for their exceptional efforts.
● SHARING THE ARTISTIC ADVENTURE:
Friends, Feedback, and the Final Frontier! During the process, we encourage you to share the artwork with your friends and colleagues. We value their opinions and understand that collaboration is part of the fun. However, please keep in mind that any changes or opinions shared after the final sign-off will not be considered. If additional work is required, whether it’s small changes or a full-scale redo, we’ll provide you with a separate quote for the new requests. Let’s keep the creative train on track!

Your Digital Dream, Our Reliability Regime!A remarkable website goes beyond its initial creation and launch. It requires ongoing care to stay secure, functional, and effective. That’s why we’re delighted to offer you our comprehensive hosting and maintenance support package, ensuring your website remains at its best while you focus on running your business.
1. Hosting & Maintenance Support (Ongoing Service)
Hosting
Cloudscape Creative offers secure, reliable hosting to keep your website online and performing optimally. Our hosting package includes:
Server maintenance and monitoring
Regular backups
Security updates and patches
Proactive troubleshooting of hosting-related issues
While we strive to provide a seamless hosting experience, certain software or email-related issues (e.g., Outlook configurations) fall outside our direct control. We’re happy to provide guidance where possible, but full IT support is not included in our hosting package. We recommend having an internal or third-party IT resource for broader software issues.
Ongoing Website Maintenance
Your website is a dynamic entity that needs regular attention. Our maintenance package covers:
Routine software and plugin updates
Security audits and malware prevention
Performance enhancements
Minor content updates (text and image changes within reason)
Security & Spam Control: We take proactive measures to protect your website from malicious attacks, spam, and other online threats. However, no system is invulnerable. If a critical security issue arises that requires extensive remediation, we will provide an estimate for additional work.
Training & Self-Management: For clients who wish to handle basic website updates themselves, we offer training sessions to guide you through making minor content changes.
2. General Web Support & Assessment (For Sites We Didn’t Build)
We understand that businesses often inherit websites built by other developers. If you need assistance with an existing website we did not create, we can evaluate its current state and provide recommendations for maintenance, improvements, or potential rebuilding. However, our liability and responsibility for inherited sites are limited, as outlined below:
Scope of Web Support Engagement
When assessing or providing support for a website we did not originally develop:
We do not guarantee the functionality, security, or stability of the existing code or third-party integrations.
We reserve the right to decline support if the website’s structure is outdated, insecure, or too complex to maintain efficiently.
Any work performed on an inherited site will be billed separately unless a custom agreement is made.
Limitation of Liability & Client Responsibility
Pre-existing Issues: The Client acknowledges that before engaging Cloudscape Creative, they are solely responsible for their website’s condition, including security, backups, and prior maintenance (or lack thereof). We do not accept liability for past issues, including but not limited to data loss, security breaches, or site instability.
Modification Risks: Any changes or troubleshooting we perform on an inherited website carry an inherent risk, especially if the original build was not properly maintained. The Client agrees that Cloudscape Creative will not be held liable for any unintended consequences, including unexpected downtime or functionality loss.
Third-Party Dependencies: If an inherited website relies on third-party services (e.g., old plugins, custom integrations, or external hosting providers), we cannot guarantee their continued functionality.
Temporary Fixes & Goodwill Assistance
If we provide one-time troubleshooting or emergency assistance, this does not establish an ongoing support obligation. Such services are provided on an “as-is” basis, and further corrective work may be required at the Client’s expense.
Indemnification & Waiver of Claims
The Client agrees to indemnify and hold Cloudscape Creative harmless against any claims, losses, or damages resulting from:
Pre-existing website issues before our engagement
Failures caused by third-party service providers (e.g., hosting companies, outdated plugins)
Unauthorised modifications made by the Client or external parties
By engaging Cloudscape Creative, the Client acknowledges and agrees to these terms, waiving any claims related to data loss, corruption, or service interruptions beyond our direct control.
3. Priority Support & Service Continuity
Clients subscribed to our ongoing Hosting & Maintenance Support package receive priority access to our support channels for any hosting-related concerns. For all other web support requests, assistance is provided on a case-by-case basis and subject to availability.
With this addendum, we aim to ensure transparency, protect both parties, and deliver the best possible web experience within a clear and sustainable framework.
